  New FCC Ruling Requires CIPA Modifications Effective July 1, 2012

 

In August of 2011 the FCC released  Order and Report (11-125) which  adds staturory language from the ‘Protecting Children in the 21st Century Act’ to the ERATE rules related to the Children’s Internet Protrection Act (CIPA).   The statutory language is added “verbatim”.  The FCC, within the scope of 11-125, also makes “non-substantive" revisions to Commission rules to conform to existing statutory language from the CIPA statutes where necessarry.  Finally, minor corrections are made to the FCC’s ‘Schools and Libraries Sixth Report and Order’.  

 

These changes become effective July 1, 2012.

Funding for Schools and Libraries - 2011

 

Several weeks ago the FCC, in concert with the USAC, approved nearly $400 Million in funds for applicants that had requested funding for 2011.  This figure - though impressive - is actually less than 10% of the overall monies sought ($4 Billion).  As stated below, by Chairwoman Campbell, "these funding decisions are especially important now..."

To Curb "Inappropriate Conduct" FCC Introduces New Rules for SPIN Changes

 

The FCC released a 150-page Order in September of 2010.  There are numerous changes, modifications and improvements to the ERATE filing process. (The complete document - FCC 10-175 - can be downloaded from the

 FCC website ). 

 

Important guidelines have emerged within 10-175 regarding SPIN Changes.  Carrier changes are referred to as SPIN changes - SPIN is short for Service Provider Identification Number.  (Phone Companies, Internet Providers are referred to as "Carriers" in telecom lexicon.)

 

If your school or library is changing from an existing Carrier (Service Provider) to a new and different vendor - you need to contemplate these new rules.  With the release of 10-175 the new rules governing SPIN changes take effect with Funding Year 2011.

Make sure your ERATE consultant has apprised you of these changes before switching carriers.
